Welcome to Emefo. By accessing emefo.com and using the Emefo platform (the “Service”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, please refrain from using the Service.

Acceptance of Terms

These Terms constitute a binding agreement between you and the operator of Emefo. By accessing or using the Service, you acknowledge and agree to comply with these Terms and any applicable policies. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

We may update or modify the Terms from time to time. When we post changes, the changes will take effect immediately or as stated at the time of posting. Your continued use of the Service after the posting of revised Terms constitutes your acceptance of the modifications.

Intellectual Property

All content and materials that appear on the Service, including but not limited to the Emefo brand, logos, design, text, graphics, software, and underlying technology, are owned by Emefo or its licensors. The compilation of the content presented on the Service is protected by intellectual property laws. You may access and view the content for personal, internal business, or otherwise legitimate purposes, but you may not reproduce, distribute, modify, republish, translate, create derivative works, or otherwise exploit any portion of the Service without our prior written consent, except as expressly permitted by these Terms or applicable law.

If you upload or submit content to the Service (for example, reviews or submissions), you grant Emefo a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute that content solely as needed to operate and improve the Service, in accordance with your privacy settings. You retain ownership of your content unless you explicitly transfer ownership to us.

Third-Party Links and Content

The Service functions as a directory for apps that are hosted on Google Play. When you choose to view an app listing or initiate a download, you will be redirected to the Google Play store. Emefo does not host the apps themselves, does not control Google Play, and makes no representations about the quality, safety, legality, or reliability of those apps or Google Play’s terms. Any transactions, terms, or dealings with Google Play are between you and Google, not Emefo.

From time to time, the Service may display third-party content such as reviews, metadata, or promotional material. Such content is provided “as is” without warranties of any kind by Emefo, and your use of such content is at your own risk. Emefo disclaims all responsibility for third-party content and actions taken on external sites.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” EMEFO AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS, AND LICENSORS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND TITLE. EMEFO DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. ACCESS TO OR USE OF THE GOOGLE PLAY STORE IS AT YOUR OWN RISK. TO THE EXTENT ALLOWED BY LAW, EMEFO PROVIDES NO WARRANTY REGARDING THE ACCURACY, TIMELINESS, OR RELIABILITY OF ANY CONTENT ON THE SERVICE OR LINKED SITES.

Limitation of Liability

IN NO EVENT SHALL EMEFO OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE. IN NO EVENT SHALL EMEFO'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNTS YOU PAID EMEFO FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM, IF ANY.

Indemnification

You agree to defend, indemnify, and hold harmless Emefo and its officers, directors, employees, agents, and affiliates from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Emefo is incorporated, without regard to its conflict of laws provisions. Any disputes arising out of or relating to these Terms or the Service shall be resolved in the state or federal courts located in that jurisdiction, and you irrevocably consent to the jurisdiction of such courts.

Entire Agreement

These Terms, together with any policies referenced herein, constitute the entire agreement between you and Emefo regarding the Service and supersede all prior understandings or agreements, whether written or oral.

Changes to Terms

Emefo reserves the right to modify these Terms at any time. We will endeavor to provide notice of material changes by posting an updated Terms page and adjusting the “Last Updated” date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
